If a vehicle is provided by the employer through a car hire firm and there is an accident, who has a duty of care?

Q: If a vehicle is provided by the employer through a car hire firm and there is an accident, who has a duty of care, and who is liable for workers’ compensation and damages?

A: Assuming you have a contract with the car hire firm that provides vehicles and the driver is one of your employees, you will still have a duty of care and be liable for workers’ compensation and damages in the event of an accident. There may also be public liability exposure for the car hire firm.
