We operate a business within NSW. Do we need to comply with the codes of practice relevant to our business?
Codes of practice are only advisory, meaning that a person or business cannot be prosecuted for failing to comply with an approved code of practice. However, if your business is prosecuted for failing to comply with its relevant health and safety duty of care, failing to observe an approved code of practice may be taken as evidence that you failed to discharge that duty. For this reason, it is strongly recommended that you comply with the relevant codes of practice to help you discharge your health and safety duties.
