Can I ask a new employee about pre-existing medical conditions, such as depression and anxiety?
In order not to breach anti-discrimination laws, you must ensure that the pre-existing medical conditions that you seek disclosure about are related to the worker’s capacity to perform the inherent requirements or tasks of their job.
If you use pre-employment tests to assess candidates, ensure that they relate specifically to the job criteria for the role the candidate is applying for. Check tests for any bias or indirect discrimination.
