WorkSafe Victoria v D & A Martin Transport Pty Ltd (2024)

D & A Martin Transport Pty Ltd (D & A Martin) operated a small logistics transport business that transported grain from depots to farms throughout Victoria's east.  

On 20 January 2022, a worker attended a workplace in Maffra with a Kenworth truck and trailer to collect grain. The top of the trailer had left and right guard rails which were raised by flicking a switch located on the rear of the trailer. These were in place to prevent a fall.
